For the past few years, players across most of the country could open a sweepstakes casino app and play blackjack for a shot at real prizes, even in states with no legal online casino. What the Sweepstakes Casino Bans Changed, and How Fast
Sweepstakes casinos built a national business on a single legal theory. Because players could obtain the redeemable currency for free, the argument went, the games were promotions rather than gambling. States are rejecting that idea in large numbers. By industry counts, at least 17 states have now banned or restricted the model since 2025, through a mix of new laws, attorney general actions and regulator cease-and-desist letters. The pace picked up sharply over the past year.
California and New York Lead the Way
The two heaviest blows came from the largest markets. In California, Governor Gavin Newsom signed Assembly Bill 831 on Oct. 11, 2025, and the ban took effect Jan. 1, 2026. The law makes operating an online sweepstakes game a misdemeanor, and it reaches past the casinos themselves to payment processors, geolocation providers and media affiliates that support them. By one industry estimate, California accounted for roughly 17 percent of the national sweepstakes market, so its exit reset the industry’s math overnight.
New York followed within weeks. Governor Kathy Hochul signed Senate Bill 5935A on Dec. 5, 2025, and it took effect immediately with no wind-down period. The New York law adds a new section to the state’s racing and wagering statute, defines the dual-currency model directly, and sets fines of $10,000 to $100,000 per violation. Most operators had already left after the attorney general sent cease-and-desist letters to 26 platforms earlier in the year.
The Enforcement Route: Illinois and Others
Not every state waited for a new law. Illinois regulators leaned on existing authority, sending cease-and-desist letters to dozens of sweepstakes operators and pressing further measures to treat the products as illegal gambling. Montana, Connecticut, Nevada, New Jersey, Indiana, Maine and Louisiana round out a growing group that has either passed bans or forced operators out through enforcement. In several states, platforms geoblocked local players within days of the pressure arriving.
What It Means for Blackjack Players
For blackjack players, the effect is simple and frustrating. The app that dealt you a hand last year may now show a message that your state is no longer supported. A Word on Access and Risk
As the map shifts, some players are tempted to mask their location to reach blocked sites. That is a bad idea.
